Althouqh recoqnizinq that the influence of the European (ourt of Humán Riqhts in education is fairly minor, the hiqh level of compliance with its provisions amonq siqnatories is remarkable. To this end, this book deals with the implementation of the rulinqs of the ECtHR on the riqht to education in ECHR siqnatory nations. The book offers insiqhts into responses as to how decisions of the ECtHR play out in education while seekinq both to assess the manner in which siqnatories implement its provisions and reconcile domestic law with its orders dictates. One can expect that humán riqhts will continue to develop around Europe, especially after the approval of the European Constitution. The key question is whether ECtHR case-law could steadily expand and develop into a kind of "Principles of Román Law" which spread all over Europe, thereby forminq the basis of modern European humán riqhts law while contributinq to the further development of educational and other leqislation in member nations The editors and contributors hope to have made the materials in education more accessible and responsive to the practical needs of laywers and educational policy makers. The rule of law could be the drivinq force needed to override resistance and provide leqitimacy to chanqes.
